Terms of Service for Sanchara

Welcome to Sanchara ("Sanchara", "we", "our", or "us").

These Terms of Service ("Terms") govern your access to and use of the Sanchara mobile application, website, APIs, and related services (collectively, the "Services").

By creating an account, accessing, or using Sanchara, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Services.

1. Acceptance of These Terms

These Terms constitute a legally binding agreement between you and Sanchara.

You are solely responsible for your decisions, actions, and conduct while using Sanchara.

6. Trip Creation and Participation

Trips created through Sanchara are intended for private coordination among authorized participants.

By creating or joining a trip, you acknowledge that:

Trip organizers are responsible for managing their trips.

Participants are responsible for their own conduct.

Trip information should be shared responsibly.

Only authorized participants should access trip content.

Trip organizers may invite, approve, or remove participants in accordance with available application features.

Sanchara acts solely as a platform to facilitate coordination and is not a party to any arrangements or agreements made between users.

7. Live Location Sharing

Live location sharing is provided solely to enhance travel coordination and safety.

By enabling location sharing, you acknowledge that:

Your live location may be visible to authorized members of your active trip.

You control your device's location permissions.

You may disable location sharing through your device or application settings, although doing so may limit certain features.

Sanchara does not publicly disclose your live location.

8. Emergency Features

Sanchara provides optional emergency-related features to assist users during emergencies.

These features may include:

Emergency profiles.

Emergency contacts.

Public Emergency Profiles.

Safety information.

These features are intended to provide helpful information but do not replace professional emergency services.

Users remain responsible for contacting local emergency responders when assistance is required.

9. Public Emergency Profile

If you choose to use the Public Emergency Profile feature:

You determine which information is publicly visible.

You are responsible for ensuring the information is accurate.

You may update the information at any time.

You may revoke the public access token, which immediately invalidates previously shared links.

You should share your Public Emergency Profile only with individuals or organizations you trust.

10. User Content

Sanchara allows users to create, upload, store, and share content in connection with trips and other Services.

User Content may include, but is not limited to:

Profile information.

Profile photographs.

Trip information.

Waypoints.

Routes.

Trip photographs.

Comments or notes.

Emergency profile information.

Other content submitted through the Services.

You retain ownership of the content you submit to Sanchara.

10.1 License Granted to Sanchara

By uploading or submitting User Content, you grant Sanchara a limited, non-exclusive, worldwide, royalty-free license to:

Store your content.

Process your content.

Display your content to authorized users.

Synchronize content across your devices.

Transmit content as necessary to provide the Services.

Create backup copies for operational purposes.

This license exists solely for the purpose of operating, maintaining, improving, and providing the Services.

Ownership of your content remains with you.

You are solely responsible for the content you upload, publish, or share through Sanchara.

You represent and warrant that:

The content does not infringe the rights of others.

The content is accurate to the best of your knowledge.

You agree to use Sanchara responsibly and in a manner that respects other users and the integrity of the platform.

You agree to use the Services only for lawful purposes.

12. Prohibited Activities

You must not use Sanchara to:

Violate any applicable laws or regulations.

Harass, threaten, or intimidate others.

Upload false, misleading, or fraudulent information.

Share another person's personal information without authorization.

Access another user's account without permission.

Attempt to bypass security mechanisms.

Reverse engineer, decompile, or disassemble the Services except where permitted by applicable law.

Introduce malware, viruses, or malicious code.

Interfere with the operation or security of the Services.

Use automated tools to scrape or harvest data without authorization.

Violation of these Terms may result in suspension or termination of your account.

13. Respect for Other Users

Sanchara is built to foster collaboration and safe travel experiences.

Obtain permission before sharing another person's personal information.

Use communication features respectfully.

Avoid abusive, discriminatory, or offensive behavior.

We reserve the right to remove content or restrict access where necessary to protect users or the Services.

14. Intellectual Property

The Sanchara application, website, backend systems, APIs, software, branding, designs, logos, graphics, text, and other materials provided by Sanchara are owned by or licensed to Sanchara and are protected by applicable intellectual property laws.

Except as expressly permitted by these Terms, you may not:

Modify.

Redistribute.

Sell.

License.

Create derivative works from.

Publicly display.

Commercially exploit.

any part of the Services without prior written permission.

14.1 Trademarks

"Sanchara," its logos, branding, and related identifiers are trademarks or distinctive brand assets owned by Sanchara or its licensors.

Nothing in these Terms grants you any right to use our trademarks without prior written permission.

14.2 Feedback

We welcome suggestions and feedback regarding Sanchara.

If you voluntarily submit ideas, suggestions, feature requests, or other feedback, you agree that we may use that feedback without any obligation to compensate you.

This does not affect ownership of your separate intellectual property.

15. Copyright

If you believe that content available through Sanchara infringes your copyright or other intellectual property rights, you may contact us with sufficient information to investigate the matter.

Where appropriate, we may remove or restrict access to allegedly infringing content while we review the claim.

Repeated infringement may result in account suspension or termination.

16. Open Source Software

Certain components used within Sanchara may include open-source software licensed under their respective licenses.

Nothing in these Terms limits your rights under the applicable open-source licenses.

Copies of applicable licenses may be provided where required.

Certain features of Sanchara rely on third-party services.

Navigation features provided by Sanchara are intended to assist users during travel.

Navigation information may be based on data supplied by third-party providers and may not always reflect current road conditions, closures, traffic, construction, hazards, or local restrictions.

You acknowledge and agree that:

Navigation guidance may not always be accurate.

Road conditions may change without notice.

Temporary hazards may not be reflected.

You remain responsible for selecting safe and lawful routes.

Always exercise independent judgment while traveling.

22. Weather Information Disclaimer

Weather forecasts and alerts are provided for convenience only.

Weather information:

May be delayed.

May contain inaccuracies.

May differ between providers.

Should not be relied upon as the sole basis for safety decisions.

Before traveling in potentially hazardous conditions, users should consult official weather authorities and local advisories.

23. Live Location Disclaimer

Live location sharing is intended solely to assist trip coordination and improve travel awareness among authorized trip participants.

Although we strive to provide accurate and timely location updates:

GPS signals may be inaccurate.

Device hardware may affect precision.

Internet connectivity may delay updates.

Battery-saving features may reduce update frequency.

Third-party mapping services may introduce inaccuracies.

Accordingly, live location should not be considered a precise or guaranteed representation of a user's exact real-time position.

24. Emergency Features Disclaimer

Sanchara provides emergency-related features as tools to assist users and those responding to emergencies.

However, Sanchara:

Is not an emergency response service.

Does not operate emergency call centers.

Does not dispatch police, ambulance, fire, or rescue services.

Does not guarantee that emergency contacts will receive notifications immediately or at all.

Does not guarantee that emergency information will be viewed during an emergency.

Users remain responsible for contacting local emergency services whenever immediate assistance is required.

Emergency information should be kept accurate and up to date by the user.

25. Public Emergency Profile Disclaimer

The Public Emergency Profile is intended to make user-selected emergency information accessible through a unique public link.

By enabling this feature, you acknowledge that:

You are responsible for determining what information is publicly visible.

Anyone possessing the active public link may access the information you have chosen to share.

Sanchara cannot control how recipients use or distribute information after they have accessed it.

Revoking the public access token prevents future access through previously issued links but cannot retract information that others may already have viewed or recorded.

Users should carefully consider the information they choose to make publicly available.

26. Third-Party Service Disclaimer

Certain features depend upon services provided by independent third parties.

These services may include:

Mapping providers.

Navigation providers.

Weather providers.

Email delivery services.

Push notification services.

Analytics providers.

Cloud hosting providers.

Sanchara does not control these third-party services and is not responsible for:

28. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis.

Sanchara expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of:

30. Your Responsibility

You are responsible for maintaining your vehicle in a safe operating condition.

You should never operate a vehicle in a manner that distracts from safe driving.

You should not interact with the application in a way that compromises your attention while driving or riding.

Where possible, passengers should operate the application on behalf of the driver.

31. Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Sanchara, its owners, employees, contractors, affiliates, licensors, and service providers from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:

32.1 User-Initiated Termination

You may stop using Sanchara at any time.

You may also request deletion of your account in accordance with our Privacy Policy and Account & Data Deletion Policy.

Termination of your account does not automatically remove information that must be retained to:

Comply with legal obligations.

Resolve disputes.

Prevent fraud or abuse.

Maintain the integrity of shared trip records.

Enforce these Terms.

32.2 Effect of Termination

Upon termination:

Your right to access and use the Services will cease.

Certain information may remain in accordance with our Privacy Policy.

We are not obligated to continue supporting any particular feature indefinitely.
